Guardian
A person appointed by a court (or named in a will) to care for a minor child or an incapacitated adult. A guardian of the person makes personal and healthcare decisions. A guardian of the estate manages financial affairs.
Legal Definition
A person appointed by the court to have the care, custody, and control of a minor or incapacitated person (guardian of the person) and/or to manage their property and financial affairs (guardian of the estate).
Practical Example
In their wills, Dan and Amy name Amy's parents as guardians for their young children. If both Dan and Amy die, Amy's parents would have legal authority to raise the children, enroll them in school, and make medical decisions.
