Ancillary Probate

A secondary probate proceeding required in a state other than where the deceased person lived, when they owned real property in that other state. This is in addition to the primary probate in their home state.

Practical Example

Uncle Bob lived in New York but owned a vacation condo in Florida. His estate goes through primary probate in New York and ancillary probate in Florida for the condo. A living trust could have avoided the ancillary probate.
